These terms apply when you use vagilant.care, the Vagilant online assessment, and any reports it produces. By creating an account you agree to them. If you do not agree, please do not use the service.
1. Who you are contracting with

2. Vagilant is not medical advice
This is the most important term here.
Vagilant is a wellness and health-monitoring product for educational purposes. It is not a diagnostic medical device. It does not diagnose bacterial vaginosis, yeast infections, sexually transmitted infections, pregnancy, cancer, or any other condition. It does not tell you whether you need treatment, and it is not a substitute for examination, testing or advice from a qualified healthcare professional.
Never delay seeking medical advice, disregard advice you have been given, or start or stop any treatment because of something Vagilant told you.
If you have severe pain, heavy bleeding, fever alongside vaginal symptoms, or any symptom that worries you, seek medical care immediately.
3. Eligibility
You must be at least 16 years old to create an account. You must provide accurate information and keep your login credentials secure. You are responsible for activity on your account.
4. Using the service properly
You agree not to:
- Use Vagilant for anyone other than yourself, or enter another person's health information without their consent.
- Attempt to access other users' accounts or data.
- Reverse engineer, scrape, overload or interfere with the service.
- Resell, redistribute or commercially exploit reports produced by Vagilant.
- Use the service unlawfully or to harm anyone.
5. Your content and your data
Your assessment answers and sensor readings remain yours. You grant us only the permission needed to process them and produce your results, as described in the privacy policy. We do not sell your data, and we do not claim ownership of your health information.
6. Our content
The Vagilant name, branding, website, assessment and written content are owned by us and protected by intellectual property law. You may read and share our articles with attribution; you may not republish them wholesale or present them as your own.
7. Accuracy and availability
We work to make the assessment and its guidance accurate, but we do not warrant that results are complete, error-free, or suitable for any particular purpose. Biosensor readings depend on how the liner is worn and read, and can be affected by factors outside our control.
The service is provided "as is". We may change, suspend or discontinue any part of it, and we do not guarantee uninterrupted availability.
8. Purchases
Vagilant has not launched commercially. When the product goes on sale, pricing, shipping, returns and cancellation terms will be published before purchase and will form part of these terms. Nothing on this site is currently an offer to sell. [TO CONFIRM: commercial terms pending launch.]
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, or for any decision you make about your health based on Vagilant's output. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.
Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
10. Ending your account
You can delete your account at any time from your account settings, which permanently erases your data. We may suspend or terminate accounts that breach these terms, and will tell you why unless we are legally prevented from doing so.
11. Changes
We may update these terms. If a change is material we will notify you by email before it takes effect. Continuing to use the service after that means you accept the updated terms.
12. Governing law
These terms are governed by the laws of [TO CONFIRM: pending incorporation], without affecting any mandatory consumer protection rights you have where you live.
